PRAYER : The Plaint filed under Order VII Rule 1 of CPC and Rule IV Rule 1 of CPC read with Order IV Rule 1 of High Court Original Side Rules praying to pass a judgment and decree against the defendant:-

a) A Permanent injunction restraining the Defendant by himself, his contractual manufactures, servants, agents, transporters, distributors, stockiest, wholesalers, dealers, retailers, advertisers or any one claiming through or under them from infringing the plaintiffs registered design which subsists in design.no.271058 by restraining the defendant or anyone claiming through or

under him from copying, using or dealing in any manner with the impugned design;

b) A permanent injunction restraining the Defendant, its directors, sister concerns, associates, assigns in business, contractual manufactures, servants,agents, transporters, distributors, stockiest, wholesalers, dealers, retailers, advertisers or any one claiming through or under them from manufacturing, selling, offering for sale, advertising, directly or indirectly passing off plaintiffs product in any manner whatsoever;

c) A preliminary decree be passed in favor of the plaintiffs directing the defendant to render account of profits made by use of plaintiffs registered design and a final decree be passed in favor of the plaintiffs for the amount of profits thus found to have been made by the defendant after the latter have rendered accounts; d)The Defendant be ordered to pay to the plaintiff a sum of INR

3,10,000/- towards compensatory and punitive damages towards the illegal activities by the defendant;

e) The Defendant be ordered to delivery up to the plaintiffs or destruction of all the products bearing the impugned design; and

f) for costs of the suit.
