ORDER

Heard the learned counsel for the petitioner. The learned counsel for the petitioner submitted that the petitioner, being the only surviving Class I legal heir of the deceased, Pranav Aggarwal, has filed the present Original Petition seeking issuance of a Succession Certificate in respect of the debts and securities standing in the name of the deceased, Pranav Aggarwal.

OP No. 215 of 2026

2. The learned counsel for the petitioner has also fairly brought to the notice of this Court that the deceased, Pranav Aggarwal, was married and that his marriage was subsequently, dissolved by an order dated 18.08.2022, passed in O.P. No. 686 of 2022, on the file of the II Additional Family Court, Chennai. A copy of the said divorce order has been marked as Ex. P5. The deceased left behind his mother, the petitioner herein, as his only surviving Class I legal heir. The deceased and his former wife were not blessed with any children. The Death Certificate of the deceased has been marked as Ex. P1, and the Legal Heirship Certificate has been marked as Ex. P2.

3. I have perused the oral evidence adduced by P.W.1 and the documentary evidence filed in support of the petition. Upon consideration of the same, I am satisfied that the petitioner is the only surviving Class I legal heir of the deceased and is entitled to seek issuance of a Succession Certificate in respect of the debts and securities left behind by the deceased. A general paper publication, as directed by this Court, was also effected in the Tamil daily newspaper "Makkal Kural", and the same has been proved through the P.W.1. I am, therefore, satisfied that the petitioner has made out a case for the grant of a Succession Certificate as prayed for.

OP No. 215 of 2026

4. In fine, this Original Petition is allowed. A Succession Certificate shall be issued in favour of the petitioner, authorising her to collect the debts and securities specified in the schedule, to receive the interest and dividends thereon, and to negotiate or transfer the securities, in accordance with law. 06-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No RKP
