ORDER

The present writ petition has been filed to direct the respondent to consider the petitioner's representation for appointment under the ‘land loser’ category.

2. The learned counsel for the petitioner submitted that the land was acquired during 2007 and at the time of acquisition, it was promised by the department that they would give an employment. In this regard, he has sent a representation to the respondents during 2020. However, the said representation has not been considered by the respondents.

3. At this juncture, the learned Special Government Pleader for the respondents objected this application on the ground that as on the date of filing of the writ petition, the petitioner is aged about 37 years and the land was taken during 2007 and due compensation had been given to them. Even for argument's sake if the petitioner is eligible for land loser category, considering the long delay there will not be any obligation on the part of the respondents to consider the petitioner’s representation. The learned Special Government Pleader further contended that the appointment took place only through the employment exchange, hence prayed to dismiss the application.

4. I have given my anxious consideration to either side submissions and perused the materials available on record.

WP No. 18859 of 2022

5. Though this writ petition is initially appears to be a consideration of the representation, the representation stems out of the alleged scheme of providing job on account of acquisition. However, considering the fact that the acquisition took place during 2007, the representation which had been given by the petitioner after 13 years. As rightly contended by the learned Special Government Pleader, the above representation would hit by the principles of delay and laches. Furthermore, the learned Special Government Pleader submitted that the appointment would only take place through employment exchange and if there is any priority, it must only be routed through employment exchange and there are no consideration of the petitioner separately as a different category.

6. In such view of the above factual position, this Court absolutely does not find any merits to allow the writ petition. Accordingly, the writ petition stands dismissed. No costs. 06-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No NR
