Order

This writ petition has been filed seeking a direction to the respondents 1 and 2 to forthwith remove the restriction / freeze imposed on Folio No.17039755, HDFC Mutual Fund, Puducherry being illegal, arbitrary, unreasonable, disproportionate, without authority of law and violation of constitutional rights and permit operation of the said Folio No.17039755, HDFC Mutual Fund, Puducherry solely for the educational expenses of the petitioner’s minor son-Dharnish.

2. The petitioner is the wife of deceased P.Ayyappan, who, during his lifetime, invested a sum of Rs.1,00,00 in HDFC Mutual Fund under Folio No.10335823. The petitioner was registered as a nominee and after submission of requisite documents, the mutual funds were transmitted in her favour and continued in Folio No.17039755. However, when the petitioner attempted to withdraw the amount, the folio was locked. On enquiring about the same, she was informed that Folio had been locked on 16.04.2026 by the Cyber Crime Police owing to the filing of partition suit. On issuing a legal notice dated 01.06.2026 to the HDFC Mutual Fund Investor Service, the petitioner was informed by a reply notice dated

05.06.2026 that the account was locked due to pending litigation to safeguard the interests of all parties. Hence, the present writ petition has been filed seeking the aforesaid relief.

3. The 2nd respondent has filed a counter wherein it has been stated as follows: “24. I respectfully submit that the civil suits instituted by me is pending before the competent Civil Courts at Cuddalore. Likewise Civil Suit Instituted by the Writ Petitioner is also pending on the file of Additional District Munsif Court, Cuddalore. The issues relating to the respective rights of the parties, including the entitlement to the amount of Rs. 1,00,000/- invested in the HDFC Mutual Fund, are the subject matter of the Civil suit OS No 440 of 2025 and ought to be adjudicated therein. Since the present Writ Petition involves disputed questions of fact and seeks to circumvent the pending civil proceedings, this Hon'ble Court may not entertain the same in exercise of its extraordinary jurisdiction under Article 226 of the Constitution of India.”

4. Considering the fact that the subject matter of the present writ petition is also the subject matter of the suit pending on the file of Additional District Munsif Court, Cuddalore in which there are rival claimants and the suit deals with multiple schedule of properties and other monetary claims, the petitioner shall work out her remedy before the Civil Court. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 06-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SRN To
