ORDER

The present writ petition has been filed seeking issuance of writ of mandamus directing the respondents to grant pension along with Commutation, Provident Fund, Earned Leave Encashment and other pensionary benefits along with interest from 01.05.2022.

2. The learned counsel for the petitioner submitted that the petitioner served in the respondent bank for almost 39 years as a Junior Associate. It is his submission that he retired on 30.04.2022. However, so far his terminal benefits have not been settled.

3. The said contention was totally objected by learned Standing Counsel for the respondents 2 and 3 and submitted that the petitioner was not at all a regular employee of the respondent bank. It is also the contention of the learned Standing Counsel that they have already raised objection with regard to the petitioner's community certificate and the matter is subjudiced before the State Level Scrutiny Committee. She also relied upon the judgment of Full Bench of this Court in batch of writ petition in W.P.No.23827 of 2025 and would contend that unless the State Level Scrutiny Committee decides, the petitioner is not entitled for any claim. The learned Standing Counsel also objects about the receipt of the representation of the petitioner dated 25.04.2022. Hence, prayed to dismiss the writ petition.

4. I have given my anxious consideration to either side submissions and perused the materials available on record.

5. Though there are factual disputes with regard to the entitlement of the petitioner's claim and the receipt of the petitioner's representation, the petitioner is not in service from 30.04.2022. Though the learned Standing Counsel would submit that certain application is pending before the State Level Scrutiny Committee, the factum is disputed by the learned counsel for the petitioner.

6. In such view of the above factual position, this Court is of the firm view that without going into the merits of the matter, the petitioner may be given liberty to give a representation to the respondents so as to get detailed reply from the respondents in respect of the stage of his terminal benefits.

7. In such view of the above position, this Court would like to dispose of the writ petition by directing the petitioner to give representation to the respondents within a period of two weeks from the date of receipt of a copy of this order. On such receipt of the representation, the respondents are directed to pass appropriate orders according to its own merits and in accordance with law within a period of eight weeks thereafter.

8. With the above directions, the writ petition stands disposed of. No costs 06-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No NR
