ORDER

The writ petition has been filed seeking a mandamus to the 3rd respondent to consider the petitioner's representation dated 17.09.2026 and to direct the 3rd respondent to issue a fresh caste certificate by taking into account the caste certificate already issued based on her mother's origin.

2. The case of the petitioner is that she belong to Hindu Adi Dravida Community. Her parents are the permanent resident of Puducherry (originally Pondicherry). Her mother Vidjeacoumary was a litigant before this Court in W.P.No.9771 of 2007, when the petitioner's sister Arthi's residential status was negatived by the third respondent. This Court had allowed the said W.P.No.9771 of 2007 on 02.09.2010 and had directed the respondents to issue a Scheduled Caste (Origin) Certificate to her sister Arthi, within four weeks.

3. The further case of the petitioner is that pursuant to the notification dated 10.09.2024 issued by the Department of Personnel and Administrative Reforms (Personnel Wing) Puducherry, the petitioner had applied for the post of

WP No. 40567 of 2026

Assistant. One of the essential criteria in the said notification was that the applicant should enclose the Community Certificate, for which purpose, the petitioner had approached the third respondent for issuance of Scheduled Caste Certificate (Origin) on the basis of her mother's origin. However, there was no response from the third respondent despite her repeated requests.

4. While so, the petitioner's mother had filed a contempt petition in Cont.P.No.57 of 2025 alleging non-compliance of the orders of this Court dated 02.09.2010 in W.P. No.9771 of 2007. Pending the contempt petition, the respondents have issued the Community Certificate to the petitioner on 25.02.025, with the endorsement that "this certificate was issued subject to the outcome of the batch of writ petition No.3239 of 2025 etc., pending before the Hon'ble Division Bench of High Court of Madras", and consequently, the contempt petition was closed. Thereafter, this Court passed an order on 22.05.2025 in W.P.No.3239 of 2025 etc., subsequent to which, the petitioner was issued a fresh certificate on 29.05.2025, removing the aforesaid endorsement.

5. Be that as it may, the first respondent had issued a notification calling for the post of UDC by way of Combined Graduate Level Examination (UDC2025) and the petitioner who had participated in the same, had succeeded. On 13.09.2026, the first respondent had issued a notification calling the

shortlisted candidates for certificate verification on 24.09.2026 A.N., and had informed that the Community Certificates should be in the prescribed format and that it should have been issued by the authority within one year from of the date of publication of results of the recruitment tests. Therefore, the petitioner had approached the third respondent on 17.09.2026, for issuance of fresh SC (Origin) Caste Certificates, enclosing the SC (Origin) Caste Certificate already issued to her and the SC (Origin) Caste Certificate of her mother D.Vidyeacoumary, who is an SC (Origin) by birth. Since there is inaction on the part of the third respondent, the petitioner once again submitted a detailed representation to the 1st respondent on 25.09.2026.

6. The petitioner would contend that the first respondent intends to publish the merit list of the aforesaid posts on 05.10.2026. Since no response is seen forthcoming from the respondents, the petitioner left with no other alternative, has approached this Court.

7. Considering the facts and circumstances of the case, a mandamus is issued to the third respondent to consider the representation of the petitioner dated 17.09.2026 and pass orders within a period of four weeks from the date of receipt of a copy of this order.

WP No. 40567 of 2026

8. With the above directions, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 06-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No DS To:
