O R D E R

(Order of the Court was made by S.M.Subramaniam,J.) This Writ Petition has been filed for a direction to the respondents 1 to 9 to remove the encroachment made in S.No.346 in Vegampur village, Kodumudi Taluk, Erode District and further direct the respondents 1 to 9 to maintain the Road Poromboke land / Government land for usage the petitioner to transport without any encroachment and to maintain as road Poromboke.

2. With reference to the relief sought for in the present Writ Petition to remove encroachments in S.No.346 in Vegampur Village, Kodumudi Taluk, Erode District, learned Government Advocate appearing for R1 to R5 and R7 to R9, on instructions would submit that competent Authorities identified encroachments. First notice was issued on 06.08.2026. By affording opportunity to encroachers, further notice was issued on 21.08.2026. He would further submit that encroachers had required for re-survey and Authorities are in the process of conducting re-survey in order to ensure that they are encroachers of public property.

3. In view of the fact that enforcement action has already been commenced, respondents are directed to proceed with the enforcement action by following procedures as contemplated under Act and Rules in force and ensure that encroachments are removed. The entire exercise is directed to be completed within a period of twelve weeks from the date of receipt of a copy of this order.

4. At this juncture, learned counsel for the impleaded respondent would submit that petitioner has also encroached upon the public property. If so, Authorities shall verify the same and initiate all appropriate action in the manner known to law, if any encroachment is identified.
