PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents 1 to 3
to remove the encroachments made by the 4th respondent in the Public pathway belongs to the 2nd respondent situated in Old T.S.No.64/4F, Ward C, Block 6 of Sivakasi Town and Municipal Corporation, Virudhunagar District now reclassified as T.S.No.118, 123/1, 123/2, 123/4, 128, 129, 130, 131, Ward C, Block 15 of Sivakasi Town and Municipal Corporation, Virudhunagar District by considering petitioners representation dated 17.04.2024, within a time frame that may be fixed by this Court.

2. According to the writ petitioner, the private respondents herein have committed encroachment in respect of the petition mentioned town survey numbers. __________

3. The learned Standing Counsel for Sivakasi Corporation fairly states that at present the petition mentioned survey numbers stand in the name of the private respondents and that the local body has given an application to the Sub- Collector for reclassification. Till such reclassification is obtained, no direction can be passed against any of the authorities. The petitioner is advised to implead himself in the proceedings now pending before the Sub-Collector and ventilate his grievance. Based on the outcome of the proceedings before the Sub-Collector, is sustained, it is open to the petitioner to file a fresh writ petition.
