ORDER

The petitioner, a Supervisor in a shop of the respondent TASMAC Limited was placed under suspension for an alleged violation of the maximum retail price (MRP). Challenging the same, the present writ petition has been filed.

WP(MD) No. 12350 of 2025

2. This Court, while entertaining the writ petition, granted an interim stay on 29.04.2025. Though the respondents have filed a counter affidavit, they have not filed an application to vacate the stay granted by this Court. Therefore, the petitioner is continuing to work as a supervisor for the respondent corporation.

3. The case of the petitioner is that he was on leave on the date of the alleged MRP violation and the salesman who was also suspended along with the petitioner has admitted his guilt and paid the fine amount. Therefore, according to the learned counsel appearing for the petitioner, the salesman has admitted his guilt and the petitioner was not on duty on the date of the alleged MRP violation. However, the petitioner was placed under suspension for the MRP violation, by the impugned suspension order dated 09.04.2025.

4. The learned Standing Counsel appearing for the respondent TASMAC submits that he is not aware of the present stage of the proceedings. However, a counter affidavit has been filed by the respondent corporation admitting that the petitioner was not present in the TASMAC shop on the date of the alleged MRP violation.

5. This Court considered the rival submissions.

WP(MD) No. 12350 of 2025

6. For an alleged MRP violation on 31.03.2025, this petition challenging the suspension order dated 09.04.2025 is pending for more than year before this Court. Pursuant to the earlier interim stay granted by this Court, the petitioner is continuing to work as a supervisor in the respondent corporation. Therefore, the impugned order of suspension would not serve any purpose. Accordingly, the impugned suspension order dated 09.04.2025 is set aside.

7. However, in the event, if any disciplinary proceedings was contemplated as against the petitioner and is pending due to the filing of this petition, the respondents are at liberty to continue the same while providing a reasonable opportunity to the petitioner. The disciplinary proceedings, if any, shall be concluded within a period of two (2) months from the date of receipt of a copy of this order. No costs. Consequently, the connected miscellaneous petitions are closed. 06-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No sji To The District Manager Tamil Nadu State Marketing Corporation Ltd., Munnipallam, Tirunelveli District.
