PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent herein not to allow the villagers of Aladikkumulai Village to burn any dead bodies on any patta lands, particularly in the residential area and in Survey Number 131/2D situated at Aladikkumulai Village, Pattukottai Taluk, Thanjavur District, and to notify the public that only licensed crematoriums should be used for burial and that failure to comply will attract legal action as per the representation dated 06.05.2026.

ORDER
The petitioner is the owner of the property in Survey No.131/3A at Aladikkumalai Village. Asserting that Survey No.131/2D, which is adjacent to the petitioner's property and owned by the eighth respondent, is being used as a cremation/burial site, the petitioner has approached this Court for a direction to restrain such practice. An interim order is in operation in relation thereto.
2. On the basis of written instructions, learned Special Government
WP(MD) No. 16107 of 2026 Pleader submits that Survey No.295/2 had been earmarked as a cremation/burial site. On account of the said site not being accessible for want of a pathway, he submits that Survey No.96/9 has now been earmarked for the above purpose. He adds that one person was cremated at Survey No.131/2D on account of the lack of access to Survey No.295/2.
3. As a result of the decision taken by the official respondents to designate Survey No.96/9, the grievance of the petitioner to prevent cremation/burial of bodies in the land in Survey No.131/2D stands redressed.
4. Recording these submissions, this Writ Petition stands disposed of without any order as to costs. It is needless to say that all applicable Rules shall be complied with before putting the alternative side to use as a cremation/burial site.
