PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the respondents 1 to 4
to remove the encroachments made by the respondents 5 to 30 in TBN road morefully in survey number 50 situated at Palanichettypatti in Veerapandi
village, Theni Taluk, Theni District on the basis of my representation dated 19.4.2025 within the time stipulated by this Court.

ORDER
(Order of the Court was made by G.R.Swaminathan J.) Heard the learned counsel for the petitioner, the learned Additional Government Pleader for the respondents 1 to4, the learned counsel for the respondents 18 and 27.
2. We direct the third respondent to conduct survey. Before conducting survey, notices will be issued to all the interested persons including the private respondents herein. Survey shall be held in their presence. If even after being put on notice, the private respondents do not present themselves at the time of contacting survey, the Tahsildar, Theni Taluk can proceed with the matter. Based on the survey results and identification of encroachers, the fourth respondent shall issue notice under Section 128 of the Tamil Nadu Urban Local Bodies Act, 1998. Encroachment in a public road cannot be permitted. If there are any encroachments as alleged by the writ petitioner, they shall be removed by adhering to due process of law. The entire exercise shall be completed within a period of six months from the date of receipt of a copy of this order.
