ORDER

(Order of the Court was made by G.R.Swaminathan J.) Heard both sides.

2. The petitioner challenges the eviction order passed by the Tahsildar, Tiruchendur. A mere look at the revenue record indicates that the petition mentioned survey number has been classified as “natham”. If natham is unoccupied, then a private individual cannot have any claim. But in the case on hand, admittedly a construction has been put up. The learned Additional Government Pleader contends that since the building has been let out in favour of State Bank of India, the petitioner cannot claim any benefit. We are not in a position to agree with her contention. When the land has been classified as

WP(MD) No. 19455 of 2024 natham, the government has no jurisdiction in the matter at all. The petitioner by putting up a construction is definitely having title over the same. The impugned order is without without jurisdiction. It stands quashed and the writ petition is allowed. No costs. Consequently, connected miscellaneous petition is closed. (G.R.S.,J.)
