PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the 1st respondent to consider the petitioner representation dated 11.06.2025 and consequently to direct the 1st respondent to remove the encroachment of 3 feet East West and 6
feet North South on the North East Staircase put up by 2nd respondent and sheds put up by respondent 3 to 5 in North South Road, in T.S.No.1779 in Santhamariamman kovil Street, Thoothukudi, Thoothukudi District within a stipulated by this Court.

ORDER
(Order of the Court was made by G.R.Swaminathan J.) The writ petitioner is a resident of Tuticorin. He alleges that there are encroachments in T.S.No.1779 in Santhamariamman Kovil Street. The learned standing counsel for the local body concedes that there are encroachments. He,
WP(MD) No. 21023 of 2025 however, states that they are unable to remove the same fearing law and order situation.
2. The first respondents shall not be dissuaded by such apprehensions. We direct the first respondent to issue notice to all the encroachers and have the encroachments removed. Encroachment in a public street is impermissible. We also mandate the sixth respondent to provide sufficient police protection to enable the first respondent to carryout the eviction drive. The entire exercise shall be completed within a period of five months from the date of receipt of a copy of this order.
