PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus or any other order in the nature of writ directing the respondents herein to consider petitioner representations dated 04.12.2023 and 23.06.2025 and consequently direct them to remove the encroachment made by the respondents 6 to 9 in NILAVIYAL SALAI which is running through Sy.No.138/2A, 139/3B, 139/3C and 139/3D and restore the said NILAVIYAL SALAI to its original position within a time frame fixed by this Court.

ORDER
(Order of the Court was made by G.R.Swaminathan J.) Heard Both sides.
2. The learned Additional Government Pleader confirms that as per the revenue record, nilaviyal pathai runs through the petition mentioned survey numbers. She further stated that the fencing put up by the private respondents was removed on 07.10.2025. We direct the respondents to maintain the said position. In other words, the nilaviyal pathai will be available for use of the general public. It is stated by the private respondents that a civil suit has been instituted. The rights of the parties would abide by the outcome of the civil suit. But till then, the status quo as on date shall be maintained.
