ORDER

The petitioner, an Assistant in the 6th respondent Co-operative Society, has been placed under suspension on 25.03.2026, on the allegation that he was responsible for theft of jewels in the Society. The petitioner submitted a representation dated 31.08.2026 seeking review of the suspension order, stating that the suspension had continued without any review and that, being totally blind, he could not have been responsible for the alleged theft. However, the said representation has not been considered. Therefore, the petitioner has filed this writ petition seeking a writ of mandamus to the second respondent to revoke the suspension order and to quash the disciplinary and surcharge __________

WP(MD) No. 28812 of 2026 proceedings, by considering his representation dated 31.08.2026.

2. When this writ petition is taken up for hearing, Mr.M.Mahaboob Athiff, learned Special Government Pleader, by referring to the proceedings of the Deputy Registrar of Cooperative Societies, Cheranmahadevi, in R.C. No.2380394/2026 SaPa, dated 01.10.2026, submits that the petitioner's representation dated 31.08.2026 has been considered in the light of the inspection report under Section 82 of the Tamil Nadu Cooperative Societies Act dated 21.01.2026 and the proceedings initiated under Section 87 of the Tamil Nadu Cooperative Societies Act, 1983 dated 07.05.2026 and rejected by proceedings dated 01.10.2026. According to the learned Special Government Pleader, a charge memo has also been issued to the petitioner on 14.07.2026. Therefore, review of the suspension order, pending grave charges, is not feasible and therefore, the petitioner’s request has been rejected.

3. This Court considered the rival submissions made.

4. Considering the scope of relief sought for in this writ petition and the proceedings of the Deputy Registrar of Cooperative Societies, Cheranmahadevi dated 01.10.2026, this Court is not inclined to pass any further orders in this petition. __________

5. Therefore, this writ petition is closed, with liberty to the petitioner to workout his remedy, by challenging the proceedings dated 01.10.2026 in the manner known to law, if he is aggrieved by the same. However, considering the case of the petitioner, who is stated to be 100% blind and has been fixed with certain responsibility for theft of jewels in the society, the respondents shall conclude the disciplinary proceedings as expeditiously as possible, preferably within a period of three months. The petitioner shall co-operate for enquiry. No costs. 06-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ogy To
