ORDER

The petitioner had submitted an application for issuance of legal heir certificate in relation to her late husband, Jagadeeswaran. The said application was rejected by order dated 06.08.2026, which is impugned herein.

2. Relying on the divorce decree obtained at the instance of the first wife, Kavitha, learned counsel for the petitioner submits that there is no impediment for the issuance of the legal heir certificate and that it is unnecessary to approach a civil court in that regard.

3. Mr.S.Iniyan Karthik, learned Government Advocate, accepts notice for the respondents. He submits that the application was rejected on account of an objection being lodged by the first wife, Kavitha.

4. The petitioner has included the ex parte divorce decree in the paper book. The said decree appears to have been issued on a petition lodged by the first wife. It is unclear from the material on record as to whether the husband filed an appeal and whether the ex parte decree was interfered with in such appeal. This aspect has to be inquired into by the respondents. __________

5. On perusal of the impugned order, the application appears to have been rejected on the ground that relevant documents were not produced. The petitioner has placed the necessary documents in the paper book. Hence, reconsideration is necessary. Towards that end, the impugned order of the third respondent is set aside and the matter is remanded for fresh consideration. After providing a reasonable opportunity to the petitioner and the first wife, a fresh order shall be issued within three (3) months from the date of receipt of a copy of this order.

6. This Writ Petition is disposed of on these terms. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 06-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No apd __________
