ORDER

(Order of the Court was made by G.R.Swaminathan J.) Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the respondents to 1 to 4 and the learned counsel appearing for the fifth respondent.

2. The petitioner is a resident of Parambur Village, Illupur Taluk, Pudukkottai District. According to him, there are encroachments in the petition mentioned survey numbers and that they should be removed.

3. The petitioner has indicated three survey numbers. They are survey No.49/9 at Pinnangudi Village and survey Nos.355/2A and 377/4 at Parambur Village. The learned Additional Government Pleader accepts that survey No.49/9 and survey No.377/4 have been classified as cart tracks. Survey has been fixed on 16.10.2026. Based on the survey results, it is proposed to take action for removing all the encroachments. This submission made by the learned Additional Government Pleader is placed on record.

4. However, they would claim that survey No.355/2A is a patta land. The SLR copy enclosed by the petitioner indicates otherwise. It appears

WP(MD) No. 29037 of 2025

that a nilaviyal pathai runs through survey No.355/2A. If during UDR, this description had been deleted, the petitioner can very well go before the jurisdictional District Revenue Officer for restoring its original position. If any such petition is filed, it shall be numbered and taken on file by the District Revenue Officer without reference to limitation and the same shall be disposed of within a period of three months, thereafter. If no such modification had been made during UDR, it would be the duty of the authorities to ensure that the nilaviyal pathai that was shown as running through survey No.355/2A is restored. This writ petition stands disposed of accordingly. No costs. (G.R.S.,J.) (M.D.S.,J.) 06-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No PMU To
