Order

This Civil Revision Petition is filed challenging the Amin's Report dated 07.10.2025, recording the delivery of the subject property to the Court auction purchaser.

( Uploaded on: 07/10/2026 01:32:31 pm )

2. When the matter came up for hearing on 01.06.2026, this Court passed the following order: The learned counsel for the revision petitioners submitted that movable properties worth approximately Rs.50 lakhs kept inside the premises were not disclosed in the Amin's Report and, therefore, the report is liable to be challenged.

(ii) The learned counsel for the respondents submitted that an appeal has already been preferred before the Hon'ble Supreme Court and a conditional order directing deposit of Rs.1 crore was passed. The said condition has been complied with and an order of status quo has also been granted. Therefore, as on date, the matter is pending before the Hon'ble Supreme Court.

(iii) The petitioners now seek investigation regarding the movable properties allegedly lying inside the premises and valued at about Rs.50 lakhs.

( Uploaded on: 07/10/2026 01:32:31 pm )

(iv) In view of the order of status quo granted by the Hon'ble Supreme Court, this Court is inclined to issue notice to the respondent.

3. When the matter is taken up for hearing today, the learned counsel appearing for the first respondent would submit that the Special Leave Petition filed by the 2nd petitioner in SLP(Civil) Diary No.4746 of 2026, challenging the judgment and decree passed in CMA.No.2116 of 2024 was dismissed by the Apex Court on 01.10.2026.

4. Therefore, as on today, there is no status quo order in view of the disposal of the main Special Leave Petition.

5. The impugned Amin's Report has been challenged on the ground that the movable property worth Rs.50,000/- kept in the subject property has not been taken note of by the Amin.

6. If it is the case of the petitioners that the alleged movable property kept in the subject property has not been noted by the Amin in his Report, it is for the petitioners to file an appropriate petition before the execution Court. The

petitioners are not entitled to challenge the Amin's Report by filing a revision. Therefore, this Court is not inclined to entertain the revision petition and the same is dismissed with liberty to the petitioners to file appropriate application before the Executing Court in accordance with law. No costs. Consequently, connected miscellaneous petition is closed. 05-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ub To The First Additional District Court, Erode.
