ORDER
This Civil Revision Petition has been filed challenging the order passed by the Principal Judge, City Civil Court, Chennai, directing enquiry regarding presentation of gold and silver articles at the time of marriage between the petitioner and the respondent.
2. The petitioner/wife filed a Domestic Violence Case in DVC No.23 of 2022 against the respondents on the file of Additional Mahila Court, Egmore, Chennai. Pending case, the petitioner filed Crl.M.P.No.497 of 2024, seeking return of Gold jewels, Silver and other household articles presented at the time of marriage. The learned Magistrate allowed the said application partly, by directing the respondents to handover 2 Kilograms of Silver and also Brass Articles, viz., Kuthu Vilakku and other household articles presented at the time of marriage. As far as the request for return of gold jewels are concerned, the Magistrate had directed that there shall be a detailed enquiry, as the same was denied by the respondents. Aggrieved by the same, the respondents filed an appeal in Crl.A.No.99 of 2025. The first appellate court has partly allowed the appeal, holding that there shall be an enquiry at the time of final hearing, regarding presentation of Gold jewels and Silver articles. Further the first appellate Court has directed the respondents to handover all the house hold __________

CRP No. 6043 of 2026 articles to the petitioner, gifted at the time of marriage, by making necessary inventories and submit the same before the Additional Mahila Court, Egmore, before which the DVC No.23 of 2023 is pending. Aggrieved by allowing of the appeal with regard to Silver Articles, the petitioner/wife has come before this court.
3. The learned counsel for the petitioner by taking this court to the counter filed by the respondents in Crl.M.P.No.497 of 2024 would submit that the presentation of the Silver articles by the petitioner’s parents at the time of marriage has not been specifically denied by the respondents. Therefore, the appellate court has committed an error in ordering enquiry regarding presentation of the Silver Article also.
4. It is pertinent to note that in Crl.M.P.No.497 of 2024, the respondents have not specifically denied the presentation of Silver Articles. However, a perusal of the counter filed in DVC No.23 of 2023, would indicate that the respondents have categorically denied the presentation of the silver articles at the time of marriage. Since the custody of the Gold jewels and the Silver Articles with the respondents is specifically denied by them, the first appellate court has rightly ordered enquiry with regard to the alleged articles in the hands of the respondents. Therefore, I do not find any error in the order passed by the first appellate court. __________
