ORDER
The Civil Revision Petition is filed challenging the Lok Adalat Award passed in Lok Adalat Case No.124 of 2023 in O.S.No.36 of 2013 on the file of the Subordinate Court, Uthangarai, Krishnagiri. Since no adverse order is going to be passed against respondents 1 to 4, notice to them is dispensed with.
2. The 1st respondent herein filed a suit for partition against the respondents 2 to 4 in O.S.No.36 of 2023 on the file of the Subordinate Court, Uthangarai, Krishnagiri. The said suit was culminated in passing of Lok Adalat Award in Lok Adalat Case No.124 of 2023. The parties to the suit namely respondents 1 to 4 herein had entered into a compromise and based on the consent of the parties, the Lok Adalat Award was passed allotting shares to respondents 1 to 4 as per the award. Aggrieved by the same, the petitioner has come before this Court.

3. According to the learned counsel appearing for the petitioner, the subject properties originally belonged to her father-Pampannan. He had two children namely the petitioner and her brother Munusamy. The respondents 1 to 4 are children of Munusamy. It is the specific case of the petitioner that the suit property is the ancestral properties of Pampannan and therefore, she is entitled to share in the said properties. However, the respondents 1 to 4 without impleading the petitioner, got a Lok Adalat Decree dividing the properties among themselves. Hence, according to the petitioner the Lok Adalat Decree is liable to be set aside.
4. The main issue involved in this matter is whether the property is the self-acquired properties of 1st to 4th respondents’ father-Munusamy or ancestral properties of Pampannan. The nature and character of the property cannot be decided in the revision petition as it requires evidence. It is brought to the notice of this Court that the petitioner herein already filed a suit for partition in O.S.No.343 of 2024 on the file of the Principal District Court, Krishnagiri against the respondents and the same is pending.
5. The issue raised by the petitioner with regard to the character and nature of the suit properties can be decided by the Civil Court in the said suit.

As far as the impugned Lok Adalat Award is concerned, admittedly the petitioner is not a party to the Lok Adalat Award. Therefore, the same is not binding on her. Notwithstanding the Lok Adalat Award, the petitioner is entitled to workout her remedy in the pending suit.
6. With this clarification, this Civil Revision Petition stands disposed of. No costs. Consequently, the connected Miscellaneous Petitions are closed. 05-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No dm
