ORDER

This Writ Petition has been filed by the petitioner for the issuance of a Writ of Mandamus, to direct the respondents to regulate the period of suspension of the petitioner from 20.02.2008 to 03.12.2009 as duty for all

WP No. 10433 of 2022

purpose as per F/R 54(1)(A) in the light of the representation made by the petitioner dated 27.08.2018 and further direct the respondent to draw and disburse the arrears of salary.

2. The learned senior counsel for the petitioner submitted that since the petitioner was prosecuted under the provisions of the Prevention of Corruption Act, she was suspended from service on 20.02.2008. It is the further submission of the learned senior counsel that subsequent to the suspension, the prosecution ended in acquittal and the disciplinary proceedings were also later on quashed by this Court. When the Department preferred a Writ Appeal, the Hon’ble Division Bench, vide order dated 05.03.2025, dismissed the application to condone the delay.

3. It is the contention of the learned senior Counsel that in such view of the factual position, the quashing of disciplinary proceeding has attained finality. Therefore, this suspension period has to be treated as a duty for all purposes as per F/R 549(1)(A). It is also submitted that a representation in this regard was made to the respondent as early as 27.08.2018.

4. In view of the above submissions, without going into the merits of the matter, this Court would like to direct the respondents to consider the petitioner's representation dated 27.08.2018 according to its own merits and in

accordance with law and pass appropriate orders within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. With the above direction, the writ petition stands disposed of. Consequently, the connected miscellaneous petition is closed. No costs. 05-10-2026 Index: Yes Speaking order Neutral Citation: Yes SHL To: The Deputy Inspector General of Police Kancheepuram Range, Kancheepuram.
