ORDER

This Writ Petition has been filed by the petitioner for the issuance of a Writ of Mandamus to direct the second respondent to grant permission to convert the Weaving Teachers post as Sewing Teachers post (Craft Teacher) in the petitioner’s school and to grant permission to fill up the same by considering the petitioner’s representation dated 05.01.2022.

2. The learned counsel for the petitioner submitted that the present writ petition has been filed seeking permission to convert the post of Weaving Teacher to Sewing Teacher. It is further submitted that a representation has already been submitted to the second respondent on 05.01.2022, which is pending before the second respondent.

3. At this juncture, the learned Government Advocate invited the attention of this Court to the judgment passed by the Hon’ble Division Bench in W.A (MD) Nos.76 of 2019, 225, 341 of 2019 and batch, wherein it was held that if surplus teachers are available, they shall be deployed to schools in accordance with the teacher-student ratio.

4. The learned Government Advocate invited the attention of this Court in respect of G.O Ms.No.39 SE dated 21.03.2003. According to the above G.O., filling up of Craft Instructor post has been banned. Furthermore, only 34 students are studying in Classes VI to VIII in the petitioner’s School. Therefore, the School is not eligible for the post of Craft instructor. As per the Right to Education (RTE) Act, a Craft Instructor post is permissible only in schools where the student strength exceeds 100. Whereas, the student strength in the petitioner's school is only 34 in Classe VI to VIII, as on the date of filing the counter-affidavit. Therefore, as rightly contended by the learned Government Advocate, the petitioner school is not entitled for the post of Craft Instructor.

5. In such view of the above discussion, this Court does not find any merit in the Writ Petition. Accordingly, this Writ Petition stands dismissed. 05-10-2026 Index: Yes Speaking order Neutral Citation: Yes SHL
