ORDER

Learned counsel for the petitioner would submit that this petitioner’s husband name is Kandasamy. One Kannammal has filed a criminal complaint before the Court stating that this petitioner’s husband has impersonated her husband. However, in the said criminal case, the petitioner’s husband was acquitted, which order was confirmed by the Hon’ble Supreme Court. In the meanwhile, Kannamal’s daughter, one Pushpa filed a writ petition seeking terminal benefits of her father, Kandasamy. This Court, vide order dated 10.09.2020, has directed the Department to pay Rs.1 lakh as lumpsum towards the benefits of the petitioner’s father.

2. It is the submission of the petitioner that there is no negative finding against the petitioner’s husband, Kandasamy. The mere sanction of Rs.1 lakh will in no way affect the petitioner’s claim to get the terminal benefits, as it is not the case of the respondent that the petitioner was never worked in the respondent Department. However, it is the complaint that he had impersonated one Kandasamy, husband of one Kannammal.

3. At this juncture, the learned Special Government Pleader would contend that notwithstanding the settlement of amount to Pushpa, daughter of

one Kandasamy and husband of Kannammal, the petitioner’s representation dated 17.06.2022, would be considered according to its own merits and in accordance with law.

4. In such view of the submissions made by the learned Special Government Pleader, without going into the merits of the matter, this Court directs the respondents 2 to 4 to consider the petitioner’s representation dated 17.06.2022, according to its own merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs. 05-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No vsi To
