Order

This writ petition is filed for the following relief: “To direct respondents to restore a suitable shop space in the redeveloped Nedunchezhian Nagar premises to the petitioner pursuant to the petitioner’s representation dated 21.05.2026.”

2. It is the case of the petitioner that she was originally owning petty shop measuring 100 sq.ft which was allotted to her by the 1st respondent board on 28.05.2002. In the year 2021, the respondents decided to demolish the tenements as it had become dilapidated and to construct new tenements. The petitioner was assured that on the new construction being put up she would be allotted a space in the newly constructed building. However, it is her contention that after the construction has been put up she has not been allotted the space and her repeated requests have fallen on deaf ears. Therefore, the petitioner has come forward with this writ petition.

WP No. 40308 of 2026

3. Today, when the matter is taken up for admission, the learned Standing Counsel submitted that it is not possible to accommodate the petitioner as the shops are now measuring 450 Sq.ft., However, he would submit that the petitioner’s representation will be considered.

4. Therefore, the respondents are directed to consider and pass orders on the petitioner’s representation dated 21.05.2026, within a period of 3 weeks from the date of receipt of a copy of this order. If the respondents have allotted shops to the earlier occupants, it is needless to state that the petitioner shall also be duly accommodated.

5. With the above direction, this writ petition is disposed of. No costs. 05-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No KAN
