Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing 1 to 4
respondents to remove the encroachment made by the Private Respondents in S.F.Nos.307/4 and 118/4 in Government Promboke classified as pathway for an extent of 0.28.00 and 0.2.00 Hectors are situated at T.Edayapatti Village, Marungapuri Taluk, Trichy District.
Consequently direct 1 to 4 respondents recover the damage caused to the Government on the basis of petitioner's representation dated 09.06.2021
and 16.06.2025 within time frame fixed by this Court.

ORDER
(By G.R.Swaminathan, J.) Heard both sides.
2. The writ petitioner is a resident of T.Edayapatti Village. He alleges that there are encroachments in the petition mentioned survey numbers. He wants the same to be removed.
3. When the matter was taken up for hearing, the learned Additional Government Pleader clarified that both the survey numbers have been classified as “pathways”. Encroachment in a pathway cannot be permitted. She submits that there are no encroachments in S.No.118/4. This submission is placed on record. She however states that there are encroachments in S.No.307/4. If that be so, we direct the respondents 3 and 4 to adopt the procedure set out in the relevant statute, issue notice to the concerned parties and remove the encroachment as per law. This exercise shall be completed within a period of four months from the date of receipt of a copy of this order.
