ORDER

(By G.R.Swaminathan, J.) Heard both sides.

2. The writ petitioner is a recent purchaser of a property comprised in T.S.No.31/3, 4 and 14, Block No.32 Ward No.2 in Madurai falling within Madurai Corporation limits. The petitioner is aggrieved by the construction put up on the western side. Admittedly the petitioner's patta land has not been gobbled up by the authorities. The authorities have only put up some constructions on a public road. When the petitioner purchased the property, these constructions were very much available.

3. It is not as if the petitioner's frontage or access rights have been affected in any way. Be that as it may, we direct the respondents to pull down the tin structure. The permanent structures such as the Anganwadi Center and Fair Price Shop can very well remain. The respondents give an undertaking before this Court that no further construction in any form will be put up on the western side of the petitioner's property.

4. This writ petition is disposed of accordingly. No costs. (G.R.S. J.,) & (M.D.S. J.,) 05.10.2026 NCC : Yes/No Index : Yes / No Internet : Yes/ No ias To:
