ORDER

The petitioner / a Junior Assistant has been transferred from Vepur Sub- Registrar Office, Perambalur registration district to Palliyadi, Sub Registrar Office, Kanyakumari registration district on administrative grounds. Aggrieved over the same, the petitioner has filed this writ petition.

2. The learned counsel for the petitioner submits that the petitioner while working in Perambalur No.1, Joint Sub Registrar Office had noticed some illegalities and he lodged a complaint to the District Registrar. Therefore, immediately he had been posted to Veppur Sub Registrar Office on deputation, where he was working for more than 3 years on deputation. While so on 08.07.2026 the deputation order had been cancelled and he joined in the Perambalur No.1, Joint Sub Registrar Office on 09.07.2026. Again on 17.07.2026 he was transferred to Kanyakumari registration district and on 22.07.2026 he had been transferred at Palliyadi Sub Registrar Office. This transfer according to the learned counsel for the petitioner is as against the government order in GO.Ms.No.10, Personnel and Administrative Reforms Department dated 10.09.1991 and the petitioner has been transferred during the non-transfer period.

3. The learned counsel further submits that the other employees have been transferred within the district and this petitioner alone has been transferred to the Kanyakumari district. Since the petitioner has pointed out the irregularities, he has been transferred.

4. The learned Additional Government Pleader by referring to the counter affidavit submits that the petitioner has been transferred on the administrative grounds that he has been working there for more than three years. The petitioner has been deputed to Veppur, since there was an vacancy at Veppur. Now based on the vacancy available, the petitioner has been transferred to Kanyakumari District on administrative grounds. He further submits that transfer is incidental to service and therefore there is no reason to interfere with the same. The petitioner though lodged complaints, he has not prosecuted the same.

5. This court has considered the rival submissions made.

6. The petitioner is an ex-service man. He was working in the Perambalur Joint Sub Registrar Office for a period of seven years and only therefore, the petitioner has been deputed to Veppur Sub Registrar Office. Subsequently his deputation was cancelled and he was posted in the Perambalur Joint Sub Registrar Office. Thereafter he was transferred to Kanyakumari district. As pointed by the learned Additional Government Pleader, transfer is incidental to service. However, the government has framed certain guidelines vide GO.Ms.No.10, Personnel and Administrative Reforms Department dated 07.11.1994, which governs the field for transfer till date and one of the conditions is that the employees should not be transferred during the non-transfer period.

7. This court while entertaining this writ petition has not granted any interim order and the petitioner has also joined in the transferred place. Therefore, this writ petition is disposed of with liberty to the petitioner to submit a representation to the respondents and the same shall be considered by the respondents sympathetically for accommodating the petitioner in a place in and around Perambalur district. No costs. Consequently connected miscellaneous petition is closed. 05-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No DSK
