PRAYER:Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a writ of certiorarified mandamus calling for the records connected with the Impugned Order passed by the 1st respondent in Letter No. 10807/Ni (ONa)/A1/2024 dated 16.06.2026, quash the same and consequently direct the 1st respondent to grant and settle 75 percent of subsistence allowance on completion of 6 months from the date of order of suspension passed by 1st respondent dated 09.08.2024 payable in terms of FR

subsistence allowance for the period from 08.02.2025 being the date of completion of 6 months till 31.08.2026 with interest and litigation cost of Rs.20,000/- (Rupees twenty thousand) for deliberately disobeying the 1st respondents own suspension order dated 09.08.2024 for denial of enhanced allowance.

ORDER
The petitioner was working as an Assistant in the respondent Tamil Nadu Water Supply and Drainage Board. He was placed under suspension and after conducting disciplinary proceedings, he was removed from service.
2. The petitioner with a grievance that the enhanced subsistence allowance as per Rule 53(1)(a)(i) of the Fundamental Rules has not been paid to the petitioner, has submitted a representation and has also filed this writ petition.

The learned standing counsel appearing for the respondents submits that the petitioner has indulged in grave misappropriation, for which disciplinary proceedings was initiated and he was also removed from service. According to the learned standing counsel, the petitioner has not co-operated for the enquiry and enquiry could not be completed in time. Therefore, the petitioner is not entitled for the relief.

4. This court has considered the rival submissions made.
5. Admittedly the enquiry contemplated as against the petitioner was pending for a period of two years. The petitioner is eligible for subsistence allowance pending the enquiry. It appears that pending enquiry, the petitioner has been paid with subsistence allowance at the rate of 50%. As per Rule 53(1)(a)(i) of the Fundamental Rules, the petitioner is entitled for enhanced subsistence allowance at the rate of 75% beyond the period of six months pending the enquiry.

Accordingly this writ petition is allowed with a direction to the respondents to pay the enhanced subsistence allowance to the petitioner as per Rule 53(1)(a)(i) of the Fundamental Rules, beyond the period of six months till his dismissal from service, within a period of eight weeks from the date of receipt of a copy of this order.
