O R D E R
The petitioners asserted that they run a small fireworks shop in the name and style of “Radha Enterprises” in a non-residential building. It is also stated that a dispute arose between the petitioners and the landlords and that the said dispute is the subject matter of O.S.No.124 of 2026 on the file of the Principal District Munsif Court at Nagercoil. On the basis of the complaint given by the landlords, it is stated that the licence of the petitioner was cancelled under the impugned order.
2. Adverting to the petitioners' representation dated 05.09.2026, the learned counsel for the petitioners submits that copies of the
W.P.(MD) No.28533 of 2026 communications proposed to be relied upon, such as the letter dated 03.08.2026 of the Revenue Divisional Officer, were requested by the petitioners. Without providing such documents, he submits that the impugned order was passed in breach of the principles of natural justice.
3. Mr.S.I.Muthiah, learned Additional Government Pleader, accepts notice for the respondents. He submits that the document is only a report of the Revenue Divisional Officer.
4. On perusal of the impugned order, it is noticeable that the reference cites the report of the Revenue Divisional Officer dated 03.08.2026. It also appears that the said report was relied upon in the impugned order. Therefore, the interest of justice warrants reconsideration. Towards that end, the cancellation of the licence is set aside and the matter is remanded for reconsideration. After providing a reasonable opportunity to the petitioners and to any other person affected, a fresh order shall be issued within three months from the date of receipt of a copy of this order. The petitioners' licence shall remain suspended during this period.
