O R D E R

Asserting that his relative, Muthuveerasuruliammal, has executed an unregistered Will dated 15.06.2022 bequeathing the property jointly to the petitioner and his brother, the petitioner has approached this Court seeking a direction for cancellation of the legal heir certificate issued by the second respondent, including the third respondent herein.

2. Mr.R.Parthiban, learned Special Government Pleader, accepts notice for the first and second respondents. He submits that the petitioner relies on the unregistered Will dated 15.06.2022 to claim a right to the property and does not have locus standi to challenge the legal heir certificate issued by the second respondent.

3. On perusal of the affidavit in support of this Writ Petition, it is noticeable that the petitioner asserts a claim over the immovable property on

W.P.(MD) No.28580 of 2026 the basis of an unregistered Will dated 15.06.2022, which is said to be executed by the said Muthuveerasuruliammal. There is not even an assertion in the affidavit that the petitioner is one of the legal heirs of the said Muthuveerasuruliammal. In those circumstances, the relief claimed for by the petitioner cannot be granted.

4. Therefore, this Writ Petition is dismissed without any order as to costs. This order will not stand in the way of the adjudication of the civil suit bearing O.S.No.321 of 2024 on the file of the V Additional District Munsif Court at Madurai.
