ORDER

The petitioner had applied for a fresh passport. In relation thereto, the first respondent called upon the petitioner to submit proof of clearance. After submitting an explanation dated 25.09.2026, the petitioner has approached this Court for a direction to process the passport application.

2. Mr.S.M.Ashok, learned Standing Counsel, accepts notice on behalf of the first respondent and Mr.R.Mohamed Riyaz, learned Government Advocate (Crl. side), accepts notice on behalf of the second respondent.

3. Learned Counsel for the second respondent has handed over a copy of the judgment dated 02.06.2023 of the Division Bench of this Court in Regional Passport Officer v. Samsudeen Mohamed Salih and another, W.A.No.902 of 2023.

4. As held in the judgment handed over by learned counsel for the second respondent, the mere registration of an FIR is not a bar to the processing of an application for issuance or renewal of a passport. In this case, it appears that the petitioner was arrayed as the sixth accused in Crime No.258 of 2018. As on date, even the charge sheet has not been filed.

5. Considering the above aspects, this Writ Petition is disposed of by directing the first respondent to process the petitioner's application for issuance of a fresh passport in accordance with law, within a period of 3 months from the date of receipt of a copy of this order. In the meantime, should a case be registered, the petitioner would be required to obtain the permission from the Criminal Court concerned. No costs. 05-10-2026 PKN
