ORDER

The petitioner, working as an Assistant in the Tamil Nadu Special Police VI Battalion, Madurai, has been deployed to the Tamil Nadu Special Police III Battalion, Veerapuram, Chennai, by the impugned proceedings dated 28.09.2026. Aggrieved by the same, the petitioner has filed this writ petition.

2. The learned counsel appearing for the petitioner submits that by way of this impugned order, the petitioner’s promotion would be affected. Further, the petitioner’s wife is in the advanced stage of pregnancy and therefore, the petitioner has to take care of his wife. According to the petitioner, he has taken leave for 16 days to take care of

WP(MD) No. 28799 of 2026 his pregnant wife, for which, he has been deployed from Madurai to Veerapuram.

3. The learned Additional Advocate General entered appearance for the respondents and submits that the impugned order of deployment has been passed on the ground of administrative exigencies. Further, the ground raised by the petitioner that he has been deployed to Veerapuram, Chennai, in view of the medical leave availed by him, is not correct and he has been granted leave for 16 days.

4. The learned Additional Advocate General further submits that in the event, if the petitioner requires medical leave for taking care of his wife, the same would be considered by the respondents. The learned Additional Advocate General has also clarified that the apprehension of the petitioner that his promotional opportunity would be denied in view of the deployment order, is not correct and the petitioner has already been recommended for promotion.

5. This Court considered the rival submissions made.

WP(MD) No. 28799 of 2026

6. Transfer is an incident of service. The scope of judicial review in the administrative order of transfer is very limited. Moreover, the apprehension of the petitioner has already been addressed by the respondents. Therefore, this Court is not inclined to entertain this writ petition.

7. Accordingly, this writ petition is dismissed. However, there shall be a direction to the respondents to consider the case of the petitioner for promotion, if he is otherwise eligible and he may be granted leave for taking care of his wife. No costs. Consequently, connected miscellaneous petition is closed. 05-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ogy
