ORDER
The petitioner / a 100% visually impaired woman has been appointed as BT Assistant (Social Science) on 01.04.2010 in the Government High School, Puzhuthipatti, Sivagangai district. Thereafter, she was transferred to Kottanathampatti, Madurai district on 07.08.2012. While so the petitioner submitted a request for posting her in the Government Higher Secondary School, Therkutheru and she also filed a writ petition before this court in WP(MD)No.16757 of 2023. The said writ petition was disposed of on 01.08.2023 with a direction to the respondents to permit the petitioner to participate in the online transfer counselling in the next year and she had to be accommodated at the School at Therkutheru, Madurai district. Pursuant to the same, the petitioner was posted in the Government Higher Secondary School, Therkutheru, Madurai district on deputation by the 3rd respondent by his proceedings dated 27.07.2023. The period of deputation was also extended from the academic year 2024 to 2025 and the same is challenged in this writ petition.

2. The grievance of the petitioner is that instead of posting the petitioner permanently at the Government Higher Secondary School, Therkutheru, Madurai district, the petitioner has been posted only on deputation.

Since this petitioner is 100% visually impaired and in view of the earlier order passed by this court, this court has interfered with the impugned order and has also granted an order of interim stay on 03.04.2025. The respondents have filed a counter affidavit along with an application to vacate the interim order dated 03.04.2025 as follows: “The petitioner filed writ petition 16757 of 2023 for direction to issue transfer order to the petitioner in the Government Higher Secondary School, Therkutheru, Madurai District and same was disposed on 01.08.2023 with following observations; “7.This Court is inclined to give a specific direction to the respondents to permit the petitioner to participate in the online transfer counselling which would be conducted in the next academic year and she has to be accommodated in the same place." For abiding above said Court order, the petitioner was posted in Government Higher Secondary School, Therkutheru, Madurai District on deputation vide 3rd Respondent proceedings in Na.Ka.No.4660/Aa3/2023 dated 27.07.2023. Later, the period of deputation was extended from the academic year of 2024 to
WP(MD) No. 4702 of 2025 2025.Challenging the same the writ petitioner filed this present writ petition for seeking transfer order in the said place permanently.

A vacancy arose to the post of BT Assistant (Social Science) on 28.02.2023 due to the retirement of one 28.02.2023 BT Assistant (Social Science), that post was surrendered to the Government on 01.08.2022 Staff Fixation, since the said post had been surplus with teacher at the time of retirement. Hence, there is no vacancy to the post of BT Assistant (Social Science) at the time of counselling conducted to the year 2023 counselling year. In such circumstances, now we requested to sanction one needy post of BT Assistant (Social Science) in the staff fixation of the year 2024-2025 to the Government Higher Secondary School, Therkutheru, Madurai.”

In view of this stand taken by the respondents in the counter affidavit that they are considering the case of the petitioner sympathetically and necessary proposal has been made to sanction one post of BT.Assistant (Social Science) in the staff fixation year 2024-2025 to the Government Higher Secondary School, Therkutheru, Madurai, this writ petition is closed with a direction to the respondents not to disturb the petitioner and to make use of the services of the petitioner till a decision is taken by the government. No costs. Consequently connected miscellaneous petitions are closed. 05-10-2026 DSK
