ORDER

The present writ petition has been filed by one Alamelu. Her claim is that she has been working in the 3rd and 4th respondent departments as a part-time sweeper for a long time, namely, 37 years. Having the Government given a special time scale of pay in the year 2010 vide G.O.Ms.No.385 dated 01.10.2010, and having regard to the fact that the petitioner was allowed to retire on 31.08.2014, she is entitled to have a special time scale of pay from 01.10.2010 to 31.08.2014.

2. However, the said contention was strongly objected to by the learned Government Advocate, who would contend that, as per the relieving order, as on the date of the G.O., namely, on 01.10.2010 itself, the petitioner had attained superannuation and her age was 67 years on the date of the G.O.

3. At this juncture, the learned counsel for the petitioner would submit that there were certain inadvertent errors committed while giving the date of birth in the Aadhaar Card and later, the said defect was subsequently corrected in another Aadhaar Card. Therefore, according to the fresh Aadhaar Card, she had not attained superannuation.

4. However, while looking into the above factual position, as per the documents submitted by the petitioner, she had attained superannuation before

01.10.2010 itself. As rightly contended by the learned Government Advocate, since on the date of the G.O. she had attained superannuation, she is not entitled to claim benefit from the G.O.Ms.No.385 dated 01.10.2010.

5. Accordingly, the writ petition is dismissed. No costs. 01-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No JRS To
