COMMON ORDER
(Order of the Court was made by Dr.G.Jayachandran J.) These Writ Petitions have been filed challenging the proceedings in Na.Ka.No.2236/2026/A1, dated 13.08.2026, issued by the second respondent- Tahsildar in exercise of powers under Section 6 of the Tamil Nadu Land Encroachment Act,1905.
2. Learned Special Government Pleader appearing for the respondents submits that the order of the Tahsildar issued under Section 6 of the Tamil Nadu Land Encroachment Act is an appealable order and in fact the petitioner has already preferred an appeal before the District Collector and the same is pending. The date of hearing for the parties has been fixed as 15.10.2026.
3. Taking note of the fact that the challenge to an order under Section 6 of the Tamil Nadu Land Encroachment Act by way of a Writ Petition is not sustainable and the petitioner has already approached the appellate authority by way of an appeal, these Writ Petitions are disposed of with liberty to the petitioner to raise all grounds during the enquiry in the appeal. The appellate authority shall consider the appeals and pass appropriate orders in accordance with law, preferably within two weeks from 15.10.2026. There shall be no order as to costs. Consequently, the connected W.M.P.Nos.37538, 37540, 40706, 40709, 40705, 40707, 40715, 40719, 40769, 40776, 43097, 43100, 43148 and 43150 of 2026 are closed. (G.J.,J.)
