ORDER

(Order of the Court was made by Dr.G.Jayachandran J.) The petitioner herein, claiming continuous and peaceful enjoyment of the premises constructed on the land classified as ‘Poramboke Vandi Padhai’ is before this Court challenging the notice issued by the Tahsildar for the removal of encroachment, which was issued as a consequence of the dismissal of the appeal filed by the writ petitioner.

2. The learned counsel appearing for the petitioner submitted that against the dismissal of the appeal under Section 10 of the Act, the writ petitioner has preferred a revision before the Government under Section 10A of the Act, which is pending in R.P.No.14378/LD6(1) 2026. He further submitted that while the revision is pending, the Tahsildar, based on the dismissal of the appeal by the Collector, has issued the present notice for eviction. It is contended that if the impugned order is given effect, the revision petition pending before the Government will become infructous, causing irreparable loss to the petitioner.

3. The learned Additional Government Pleader appearing for the respondents submitted that the revision petition filed challenging the order

passed by the District Collector is under active consideration and will be disposed of after hearing the parties, preferably within a period of three months.

4. In view of the above facts, we dispose of this Writ Petition, directing the 2nd respondent, the Tahsildar, Thiruvarur, Taluk Office, to keep the notice dated 21.09.2026 in abeyance till the disposal of the revision petition and to take action based on the outcome of the said revision petition. Consequently, the connected Miscellaneous Petition is closed. No costs. (Dr.G.J.,J.) (E.M.,J.) 01-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No rpl To
