Challenging the communication, dated 14.07.2026 issued by the Office of the Principal Accountant General addressed to the Additional Superintendent of Police, the petitioner, daughter of the deceased Head Constable, has filed this writ petition.

2. The learned counsel appearing for the petitioner submits that the petitioner’s father, namely, M.Krishnan was working as a Head constable and retired from service on 31.05.1982. He died on 20.09.1987. Thereafter the petitioner’s mother was receiving family pension and she also died on 22.11.2021. The petitioner, being a daughter is entitled for family pension in terms of Government order No.107, Finance (Pension) Department, dated 07.03.2000. By the order impugned in this writ petition, a direction was issued to obtain a fresh guardianship certificate from the District Local Level Committee in terms of National Trust Act, 1999 and called for the Service Register of the petitioner’s father. The petitioner has submitted a fresh limited guardianship certificate, however, the respondent is demanding the Guardianship Certificate under the National Trust Act. He further submits that the petitioner is suffering from chronic severe schizophrenia and blindness and her brother is taking care of her. Therefore, he prays for suitable direction to the respondent to sanction family pension to the petitioner at the earliest.

3. When this writ petition is taken up for hearing today, the learned counsel for the Office of the Accountant General submits that certain documents are necessary to process the petitioner's request. Accordingly, the said documents have been called for from the petitioner as well as from the concerned Department.

4. The learned Government Advocate appearing for respondents 3 and 4 states that the required documents have been collected and forwarded to the Office of the Accountant General for necessary action.

5. It is submitted that the request of the petitioner for family pension was rejected by the Office of the Accountant General on the ground that the limited guardianship certificate had not been enclosed along with the proposal. It is now reported by the learned Government Advocate that the required documents have been collected and forwarded to the first respondent for necessary action.

6. In view of this subsequent development, this writ petition is allowed. The impugned order, dated 14.07.2026 is set aside, with a direction to the first respondent to consider the case of the petitioner, in the light of the documents now forwarded by the third respondent, within a period of four weeks from the date of receipt of a copy of this order. No costs. 01-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No VRN
