O R D E R
The petitioner, who was working as an Assistant Executive Engineer in TANTRANSCO, Tirunelveli Operation Circle, Tirunelveli was promoted as an Executive Engineer and posted at Kadalngudi, 230 KV Sub-Station in Nagapattinam Electricity Distribution Circle. The petitioner has approached this Court expressing certain difficulties in joining the transferred place, on the ground that his children are studying and therefore, they cannot be disturbed in the middle of the academic year. It is submitted that if he is posted at Nagapattinam, it will cause prejudice to him. __________

2. Mr.B.Ramanathan, learned Standing Counsel takes notice for the respondents and states that this petitioner has been posted at Nagapattinam on promotion. If the petitioner is not inclined to join at Nagapattinam expressing certain difficulties, he ought to have opted out of the promotion. However, after verification, the learned Standing Counsel states that there is a vacant for the post of Executive Engineer at Tuticorin Thermal Power Station.
3. This Court considered the rival submissions made.
4. Transfer is an incident of service. The petitioner has been promoted as an Executive Engineer and posted at Kadalngudi, 230 KV Sub-Station in Nagapattinam Electricity Distribution Circle. He expressed certain difficulties on the ground that his children are studying and in the middle of the academic year, they cannot be disturbed. It is also reported that there is a vacancy at Tuticorin Thermal Power Station. __________

5. In view of the above, this writ petition is disposed of, with a direction to the petitioner to join at Nagapattinam at first, as per the promotion order and thereafter submit a representation to the respondents for considering his posting at nearby available vacancy. On receipt of such representation, the respondents shall consider the case of the petitioner, in accordance with law, within a further period of ten days from thereon.
