PRAYER: S-38 Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the Respondents No.1 to 4 to allot only the duties attached to the post of Assessment Inspector and Revenue Supervisor and to refrain from compelling the petitioner and federation members to perform the duties attached to the lower post of Assessor, based on the representation dated 05.08.2026 and 01.09.2026 and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

O R D E R
The petitioner, Tamil Nadu Electricity Workers Federation, has approached this Court with a grievance that the Officers in the cadre of Assessment Inspectors are being compelled to discharge the duties of Assessors, which is a subordinate post to the post held by them, contrary to the terms of the settlement, dated 22.02.2018.
2. Mr.S.Arivalagan, learned Standing Counsel takes notice for the respondents and submits that there are vacancies in the post of Assessor and to meet out the exigencies, the Inspectors of Assessment have been requested to carry out those works. According to him, arrangements are being made to fill up the posts of Assessors and the issue will be sorted out soon.
3. This Court considered the rival submissions made and also perused the materials placed on record.

4. Admittedly, the post of Assessor is a subordinate to the post of Inspector of Assessment. The responsibility and accountability of each post have been prescribed in the settlement, dated 22.02.2018, arrived under Section 12(3) of the Industrial Disputes Act, 1947. No doubt that the respondent Management is bound by the said settlement.
5. In view of the above, this writ petition is disposed of, with a direction to the respondents to strictly comply with the settlement, dated 22.02.2018 and to take necessary/immediate steps to fill up the vacant Assessor posts.
