ORDER

By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

2. The petitioner is working as an Assistant in the Health Department. He was issued with a charge memo and is facing disciplinary proceedings. The disciplinary proceedings have been pending for the past two years. Therefore, the petitioner has approached this Court seeking a writ of mandamus directing the respondents to conclude the disciplinary proceedings within a stipulated time.

3. The learned Counsel appearing for the petitioner submits that, in view of the pending disciplinary proceedings, the petitioner has already lost his promotional opportunities. According to him, another panel is likely to be drawn and the petitioner has a good case in the enquiry. However, the enquiry has not been concluded and, therefore, once again, the petitioner's promotional opportunities would be denied.

4. Mr.C.Jeganathan, learned Special Government Pleader, who takes notice for the respondents, submits that the enquiry was contemplated against several officers, including the petitioner, and that the enquiry has already been concluded. However, the decision has to be taken by the first respondent/ disciplinary authority and, therefore, all the records have been placed before the first respondent for necessary orders.

5. This Court has considered the rival submissions made and perused the materials placed on record.

6. The Government has already issued directions in G.O. Ms. No. 81, Human Resources Management (N) Department, dated 04.08.2022, fixing the timeline for concluding disciplinary proceedings. In the instant case, it appears that the enquiry has already been concluded. However, final orders have not been passed by the first respondent/ disciplinary authority till date. In view of the same, this Writ Petition is disposed of with a direction to the first respondent/disciplinary authority to pass suitable final orders on the enquiry within a period of six weeks from the date of receipt of a copy of this order. No costs.
