ORDER

This Criminal Revision Case challenges the order passed by the learned XXXVII Metropolitan Magistrate, Fast Track Court No.IV, George Town, Chennai, dismissing the petitioner’s complaint for non-payment of the process fee for executing a warrant said to be pending against the respondent.

CRL RC No. 1977 of 2026

2. Learned counsel for the petitioner would submit that the petitioner was all along present but the respondent had been evading summons; that the petitioner ought not to be penalised only because he had not paid the process fee; and that if the complaint is not adjudicated on merits, the petitioner would put to irreparable loss and hardship.

3. This Court is of the view that the petitioner ought to be given one more opportunity to establish his case on merits. Therefore, the impugned order dated 15.04.2026 passed by the learned XXXVII Metropolitan Magistrate, Fast Track Court No.IV, George Town, Chennai, in S.T.C.No.3895 of 2022 is set aside and the complaint is restored to the file.

4. The parties shall appear before the learned Magistrate on a date fixed by the Court and thereafter, the learned Magistrate shall proceed in accordance with law.

5. Accordingly, this Criminal Revision Case stands allowed. 30-09-2026 Neutral Citation: Yes/No ham
