ORDER

This Criminal Revision Case challenges the order passed by the learned Sessions Judge, Special Court for Trial of Cases under SC/ST(POA) Act, Cuddalore, in Crl.M.P.No.56 of 2026 in RCS.No.9 of 2026, dated 22.06.2026, dismissing the petitioner’s protest petition filed against the RCS report of the respondent closing the FIR as ‘Mistake of Fact’.

2. The petitioner had lodged a complaint against the proposed accused stating that he was a member of the Scheduled Caste community; that he was running a vegetable shop in the premises belonging to the proposed accused; that the proposed accused asked the petitioner to vacate the shop and warned him of serious consequences if he failed to do so; that thereafter, the proposed accused had spread false rumour about the petitioner that he had committed misappropriation of a sum of Rs.10 lakhs from the proposed accused; and that the proposed accused abused the petitioner in filthy language and humiliated him on account of his caste.

3. The respondent police, after conducting an investigation in Crime No.344 of 2025, which was registered for offences under Sections 296 and 351(3) of BNS r/w Sections 3(1)(r) and 3(1)(s) of the SC/ST (PoA) Act, found

Crl.R.C.No. 2022 of 2026

that the allegations were not true and hence, referred the case as a ‘Mistake of Fact’. The petitioner challenged the said report by way of protest petition, which came to be dismissed on 22.06.2026.

4. Learned counsel for the petitioner relied on the statements of the PW1 and PW2 and submitted that the allegations constitute offences under SC/ST (PoA) Act and that the learned Judge was not right in dismissing the protest petition.

5. Heard the learned Additional Public Prosecutor and perused the materials available on record.

6. It is seen that the learned Judge had considered the final report of the respondent and held that the dispute between the parties arose since the petitioner was accused of misappropriating the funds of the proposed accused and that the allegation of the petitioner that he was humiliated by the proposed accused on account of his caste was exaggerated and was contrary to his earliest version.

7. On a perusal of the records and statements of the witnesses, this Court is of the view that there is no infirmity in the order of the learned Judge in accepting the final report filed by the respondent police.
