ORDER

The revision challenges the order passed by the learned Magistrate, dismissing the prayer of the petitioner, seeking registration of First Information Report on his complaint.

2. The gist of the petitioner's complaint is that the petitioner is one of the legal heirs of one Dr. K.Ravi; that his step-mother one Prema Ravoori, by making a false declaration to the Tahsidar, obtained the legal heir certificate claiming to be a legal heir, along with two others, excluding the petitioner. According to the petitioner, the act of the said Prema Ravoori would amount to cheating and would also constitute the offence of forgery and hence, he filed Crl.M.P.No.11469 of 2025, seeking a direction by the learned Magistrate to the Police for registration of the First Information Report.

3. The learned Magistrate found that the dispute is essentially civil in nature and it has to be decided only by the Civil Court and also held that if the proposed accused have misled the Revenue Authorities and had obtained a certificate, it is open to the Revenue Authorities to lodge a complaint for the offences under Sections 177 and 182 of the IPC

4. This Court finds no infirmity, whatsoever, in the order passed by the learned Magistrate, as no cognizable offence has been disclosed in the complaint made by the petitioner warranting registration of First Information Report. However, the petitioner is justified to the extent of stating that by making the false declaration, the legal heirship certificate has been obtained from the Tahsildar.

5. Therefore, the petitioner is at liberty to approach the Tahsildar for revocation of the certificate issued by him and also for prosecuting the accused for making false declaration under Section 177 of the IPC. With the above liberty, the revision stands disposed of. If any such request is made by the petitioner, the Revenue Authority concerned shall take action within a period of four weeks thereof. 30-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No (drm) To:
