ORDER

After hearing the counsel for the parties, I indicated my mind that there is no merit in the revision petition.

2. Mr.K.N.Nataraaj, learned counsel for the petitioner at that juncture stated that the petitioner has school going children and if reasonable time is granted to the petitioner, he would make necessary arrangements to vacate and handover the vacant possession of the suit property to the respondent / decree

holder peacefully without driving the respondent to forcible execution petition. In compliance with the said undertaking, today an affidavit of the revision petitioner is filed stating that the petitioner would vacate the vacant premises on or before 30.04.2027 without any obstruction or causing or creating any third party interest in respect to the suit property.

3. Mr.K.N.Nataraaj, in addition to inviting my attention to the said affidavit undertaking would also request liberty to be granted by this Court to proceed against the 2nd respondent who has taken the petitioner for a ride. It is needless to state that it is always open to the revision petitioner to claim damages / compensation against the 2nd respondent in accordance with law. Therefore, no separate liberty in this regard is necessary.

4. Learned counsel for the 1st respondent opposes the request for time till 30.04.2027. However, considering the fact that the petitioner has specifically stated that his children are studying in school and it would cause great prejudice and inconvenience if the petitioner, compelled to vacate during the academic year, I am inclined to accede to the request for time till 30.04.2026. However, it is made clear that no extension of time shall be sought for under any pretext whatsoever.
