ORDER

Heard Mr.SK.Rahul Vivek, learned counsel for the revision petitioner and Mr.Ramesh, for Mr.R.Ashwanth, learned counsel for the contesting respondents 1 to 3.

2. The parties are admittedly brothers and the present application has been filed challenging the appointment of a second Advocate Commissioner. After hearing learned counsel for the parties, on earlier occasion, I had suggested that the parties being brothers could amicably resolve the disputes among themselves, especially considering the nature and extent of the property, though it was proposed by the respondents that they would be interested in retaining the entire premises and buy out the share of the petitioner, the settlement talks in that direction have not gained any steam.

3. Today, however, the learned counsel for the parties are in agreement that the petitioner and the respondents are agreeable for the property to be sold under the supervision of an Advocate Commissioner to be appointed by this Court, in a time bound manner. The learned counsel also make a further request that the Advocate Commissioner shall file a valuation report and an upset price shall fix by the Trial Court within a month from the date of uploading of copy

of the order and a right of refusal shall be given to both parties, to meet the said offer, so that the properties can be retained within the family.

4. In the event of both parties by not willing or unable to meet the upset price that is fixed based on the assessment of the value of the property by the Advocate Commissioner, then the Court shall take steps to sell the property in public auction, so that the net moiety shall be divided equally. I hereby appoint Mrs.J.Jyothi, Advocate (Cell: 99412 77442) as an Advocate Commissioner, having address at 291, New Additional Law Chambers, to inspect the property, obtain a report from the licensed Surveyor. The parties shall pay Rs.50,000/- (Rupees Fifty Thousand only) each to the Advocate Commissioner as initial remuneration.

5. This Court directs the Commissioner to carry out the inspection with the assistance of a registered Valuer/Surveyor and file a report and sought an upset price within a period of four (4) weeks, based on which the Trial Court shall take such further steps keeping in mind the directions in Paragraphs No.3 and 4 herein above.

5. Consequently, connected Miscellaneous Petition is also closed. No costs. 30-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No RKP
