COMMON ORDER

These revision Petitions are taken up for final disposal. I have heard Mr.N.Poovanalingam, learned counsel for the revision petitioners and Mr.Jyothish Chander, learned counsel for the respondent/Caveator. Though he has filed caveat in one of the revision petitions, he has taken notice in the other two revision petitions as well.

2. The revision petitioner has suffered awards, three in number, as against which, the three revision petitions are before this Court. According to the learned counsel for the revision petitioner, the petitioners have already repaid a sum of Rs.92 lakhs.

3. However, the learned counsel for the respondent would state that there are several chit transactions between the petitioners and the respondent and therefore, the amounts that are due in these three revision petitions are still liable to be cleared by the petitioner. He would also point out that Applications are being filed seeking to set aside the exparte order of attachment. Mr.Jyothish Chander, learned counsel would clearly state that a direction can be given to the Executing Court to dispose of the Applications to set aside the exparte order of attachment, until such time, the respondent/decree holder will not precipitate the Execution Proceedings.

4. Recording the fair submission of the learned counsel for the respondent, the revision petitions are allowed with a direction to the Executing Court viz., Sub Judge, Nagapattinam, to dispose of all the Applications to set aside the exparte order of attachment filed by the revision petitioners in the following manner:-

(i) The Applications that have been filed shall be numbered, if they are otherwise in order, within a period of two (2) weeks, if any defects that are being pointed out, shall be complied with then and there without any delay by the petitioners.

(ii) On such numbering the respondent shall be given an opportunity to file a counter within a period of two weeks, thereafter within a period of four weeks, the Applications shall be decided, after holding due enquiry, subject to the result of these Applications, the respondents are at liberty to proceed with the Execution Petition in a manner known to law.

(iii) In the meantime, the petitioner shall also file a counter in the main Execution Petition within a period of two (2) weeks from the date of receipt of the copy of the order. Consequently, connected Miscellaneous Petitions are also closed. No costs. 30-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No RKP
