ORDER

This Civil Revision Petition has been filed seeking a direction to the learned VI Additional District Judge, Madurai, to dispose of the suit in O.S.No.

516 of 2023, which is pending on its file, within a time frame to be fixed by this Court.

2. The revision petitioner is the plaintiff in O.S.No.516 of 2023, filed for recovery of money on the basis of a mortgage deed and a promissory note. The said suit was instituted on 02.12.2023.

3. The learned counsel for the petitioner contended that, in the said suit, initially, the defendant did not appear and was, therefore, set ex parte. Thereafter, the plaintiff was examined and his documents were marked on 28.06.2024 itself. Subsequently, the defendant appeared before the trial Court on 26.07.2024 and filed I.A.No.1 of 2023 seeking to set aside the ex parte order. The said application was allowed on 04.02.2025. Thereafter, the matter was posted for filing the written statement by the defendant. However, till date, the defendant has not filed his written statement. Despite the same, the learned trial Judge has been adjourning the matter from time to time without insisting upon the defendant to file his written statement.

4. Since the suit is a simple suit for recovery of money and the defendant has already entered appearance, the learned trial Judge is directed to conclude the trial and dispose the suit in O.S.No.516 of 2023 at the earliest, in any event, not later than nine months from the date of receipt of a copy of this order.

5. With the above direction, this Civil Revision Petition stands disposed of. No costs.
