ORDER

This Writ Petition has been filed by the petitioner for the issuance of a

WP No. 16357 of 2022

Writ of Mandamus to direct the 2nd respondent to consider his representation to the 2nd respondent Corporation dated 26.12.2011 with last reminded dated 02.09.2021.

2. There is no representation on behalf of the petitioner.

3. In this case, the petitioner seeks his pay arrears in accordance with the law, based on the last pay drawn by him on 30.09.2009 less his pension amount for the period from 01.10.2009 to 26.11.2011.

4. At this juncture, the learned counsel for the 2nd respondent invited the attention of this Court with regard to the proceedings of the 2nd respondent vide letter No.A3/0042/2014 dated 04.10.2021. He submitted that the aforesaid prayer was not considered by the second respondent and was ultimately rejected. He further submitted that, following the rejection order, the petitioner filed Writ Petition W.P. No. 27554 of 2023, which is currently pending.

5. Though the petitioner has not confirmed the submissions made on behalf of the 2nd respondent, this Court has perused the records. On perusal of the same, it is observed that the request made by the petitioner through his representation has already been rejected. The present writ petition is based upon his representation dated 17.05.2012 and even according to the petitioner,

WP No. 16357 of 2022

the present representation is continuation of his various representations since 2011. Therefore, as rightly contended by the learned counsel for the 2nd respondent, the relief sought by the petitioner has already been considered and rejected.

6. In such view of the position, nothing survives in the present writ petition. Furthermore, it is relevant to mention that petitioner has already filed another writ petition challenging the order dated 04.10.2021. Hence, in view of the above reason, the present writ petition is dismissed as infructuous. However, the petitioner is given liberty to raise all his defences in the connected writ petition. 30-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SHL To:
