The petitioner was appointed as Irrigation Community Organiser under Nominal Muster Roll (NMR) in Parambikulam-Aliyar Project in March 1993. He further submitted that about 21 such NMR Irrigation Community Organisers approached the Tamil Nadu Administrative Tribunal, Chennai praying for regular appointment. Based on the orders passed by the Tribunal, the said 21 NMR Irrigation Community Organisers were appointed as Assistant Engineers by G.O.Ms.No.417, Agriculture (AA_III) Department dated 06.10.1997. Even though, the Tribunal passed orders on 17.06.2002, the Department took 3 years to implement the order.

4. While so, the respondent issued the seniority list of Assistant Engineers as on 01.01.2022 vide proceedings in EE5/41286/2019 dated 26.11.2022. Aggrieved by the said seniority list, the petitioner submitted a representation dated 05.12.2022, requesting to revise his seniority and place him below the Assistant Engineers who were appointed pursuant to G.O.Ms.No.417, Agriculture (AA-III) Department dated 06.10.1997.
