ORDER

The present Writ Petition has been filed by the petitioner for the issuance of a Writ of Mandamus to direct the 3rd respondent to set revised pension proposal by calculating the petitioner’s regular service with effect from 24.01.1995 to the 4th respondent by considering his representation dated 28.11.2023.

2. The learned counsel for the petitioner submitted that the petitioner was appointed as a Social Forestry Worker in the respondent department during 1983 through the Employment Exchange. Subsequently, the petitioner has filed writ petition in W.P.No.15474 of 2021. Pursuant to the order passed by this Court in the said writ petition, the petitioner's services were regularised with effect from 24.01.1995. However, the third respondent, while forwarding the pension proposal, calculated the qualifying service from 12.05.2008 instead of 24.01.1995. Consequently, the petitioner submitted a representation dated 28.11.2023, which is currently pending consideration.

3. Per contra, the learned Special Government Pleader submitted that as per the G.O.(2D) No.48, Environment, Climate change and Forests (FR.2ii) Department, dated 07.04.2022, though the petitioner’s seniority was fixed on

WP No. 18766 of 2024

par with his junior, his eligible service for pension through his regular service is 12 years, 09 months and 20 days. He further submitted that after adding 50% of the service rendered on a daily-wage basis, the total qualifying service arrives at 25 years, 3 months, and 25 days.

4. The learned Special Government Pleader submitted that there is no specific provision in the Government Order so as to give pension on par with the petitioner’s junior. Therefore, it is contended that the petitioner is not eligible for any relief.

5. At this juncture, the learned counsel for the petitioner submitted that the similarly placed persons have already been granted the relief sought by the petitioner in G.O.(2D) No.48, Environment, Climate change and Forests (FR.2ii) Department, dated 07.04.2022.

6. But, considering the fact that the petitioner’s representation has not yet been considered by the respondent and upon the submissions made by the learned Special Government Pleader, this Court directs the 3rd respondent to consider the petitioner’s representation according on its own merits and in accordance with law and pass appropriate orders within a period of eight (8) weeks from the date of receipt of a copy of this order.

WP No. 18766 of 2024

7. With the above direction, the writ petition stands disposed of. Consequently, the connected miscellaneous petition is closed. No costs. 30-09-2026 Index: Yes Speaking order Neutral Citation: Yes SHL To:
